How many H1B visas in 2014 will be rejected because of the 85,000 H1B visa cap?
Last year, over 124,000 H1B visas where submitted to US CIS in the first week of April 2013. USCIS randomly selected 65,000 for the general category and 20,000 with advanced degrees totaling 85,000. USCIS rejected about 39,000 H1B applications.
As the economy is slowly improving, most experts expect a higher number of submissions of H1B’s in 2014. Moreover, it is likely that some of the 39,000 H1B applicants that were rejected 2013 wii reapply in 2014. Therefore, it is quite possible that there will be a higher rejection percentage of H1B applications filed in April 2014.
Will Congress increase the number of H1B’s for the fiscal year of 2014. Unfortunately, the simple answer is no. Congress does not even have time to pass a bill and have it approved before the April 1, 2014 filing date. In addition, many in Congress do not have any inkling of increasing H1 B visa until the US economy is stronger and the unemployment rate is below 6%. H1B applicants need to be completely prepared to file their applications on April 1, 2014 as the H 1B visa cap will be reached immediately.
